Separation and Release Agreement Sample (US)
Parties:
Employer: XYZ Corporation
Address: 123 Business Ave, Suite 500, New York, NY 10001
Employee: John Doe
Address: 456 Elm Street, New York, NY 10002
Recitals:
WHEREAS, the Employer and Employee wish to amicably resolve all claims and disputes arising from the employment relationship; and
WHEREAS, the Employee desires to voluntarily terminate employment and release claims as set forth herein.
Termination Terms:
The Employee’s employment shall end effective as of ____________________, and the Employee agrees to return all company property, including but not limited to laptops, access cards, and documents.
Release of Claims:
In exchange for the consideration outlined herein, the Employee hereby releases and discharges the Employer, its affiliates, officers, and employees from any and all claims, liabilities, or causes of action, known or unknown, arising out of or related to the employment or its termination.
Confidentiality & Non-Disparagement:
- The Employee agrees to keep the terms of this agreement confidential.
- Both parties agree not to make disparaging remarks about each other.
Governing Law:
This agreement shall be governed by the laws of the State of New York, and any disputes shall be resolved in the courts of New York County.
Additional Provisions:
